Some of the best ways to protect against identity theft are by using common sense. Of course, you will also need to educate yourself on how identity theft happens and how often it happens, so you will understand what will give you the best protection.

- Change your passwords often and never keep them written down in your wallet, handbag or stored on or near your computer.
- When accessing your bank from internet cafes remember to clear all passwords, logins and if possible the cache in the history folder. If you cannot personally clear the history- ask an employee to do so in front of you.
- Always watch for the little lock on websites. That lock is designed to show when you are using a secure network.
- All bank and financial transactions should always be made only on websites that start with “https://”; the “s” is for secure. If the website address reads only “http://”, it is not secure and not safe for financial transactions. Also, ensure that the site does encryption of vital data.
- Be very alert about messages that ask for personal information through email; be even more cautious if it uses an “emergency” as the reason for needing the information immediately.
- Closely monitor your credit card statements for excess payments or payments or transactions that you do not remember making.
- Shred financial documents you do not need to prevent identity theft. A decent shredder can be bought for around $20. Diamond cut shredders are best.

Credit card theft can be a major irritation at the very least and a massive financial blow at its worst. Say, you are travelling and your credit cards are lost or stolen. This can, and more than likely would, create a very unpleasant turn of events, even with the best help at your disposal.

The solution is to ensure that you are protected against credit card theft to the best of your ability. A few no-cost suggestions are listed below:

- Keep your credit cards carefully in a wallet or purse in front of your body instead of in your back pocket or on your shoulder.
- Take advantage of credit card fraud protection assurance from your credit card provider. In such cases, all you have to do is reach the nearest phone and inform the credit company of the loss of the card. By doing this, you would be exempt from paying for any purchases made after the company was informed of the loss.
- Have the number on hand (more than likely toll free) and/or any other means to contact the credit card provider. Remember if you lose the card- how will get the number off the back of the card?
- Photocopy your credit cards for ready reference of the numbers and other details in the event of credit card theft. Also photocopy all identifications in the event that those are lost as well, in order to prove your identity.

If you are late by more than 30 days on your mortgage payment, the lender can declare the mortgage in default. When this happens, the owner of the house has two choices – either pay the mortgage amount due immediately or face a foreclosure lawsuit that would auction off his/ her home to recover the mortgage costs that were outstanding. If you are currently facing this scenario do not despair– you can stop foreclosure without bankruptcy declaration. In order to do this, the property owner must utilize the Chapter 13 clause, which allows the house owner some time leeway in which they could pull together resources in order to pay the lender.

Chapter 13 is a very powerful tool for people who wish to keep their homes – but it requires following stringent rules so the money due could be repaid in the court allotted time. The mere fact that you can stop foreclosure without bankruptcy is enough for most people to accept any conditions stipulated during the process. With that being said, it is best that you educate yourself on the stipulations of the Chapter 13 clause of the Bankruptcy Act so that you fully understand the process, the ramifications, the projected goal and the consequences of not meeting the specified deadline. In most cases, at least a consultation with a qualified professional is recommended.

The Chapter 10 bankruptcy is basically a clause under the US Bankruptcy Code describing how a company can save itself by applying for court protection from debtors. The Court then appoints an independent manager, who advises the company on how it should be reorganized so it can continue to function and recover from its financial crisis.

To enjoy the benefit of the Chapter 10 bankruptcy clause, the company would have to allow the Court to review its current financial condition without any limits. It would also have to accept the recommendations to reorganize itself as per the advice of the manager appointed by the Court to clear its current debt issues. The Court would carefully examine the situation and if it feels that the company is salvageable – in other words, it is possible with the help of reorganization to come out of debt, it would grant the company protection from debtors under the Chapter 10 bankruptcy clause.

Until the debt is cleared the manager would be the link between the company and the Court. The manager would also continue to have full jurisdiction over the operations of the company until the financial matters are resolved.

We hear a lot about debt counseling and everyone can agree that it is a good service to utilize in theory. Most credit repair agencies offer debt counseling for free making many consumers question its actual value. People who hire credit repair agencies feel that they are buying services only to eliminate their debt and may feel they do not need to understand what and how debt is handled or created. Wrong.

Just like a doctor would advice a patient on what has caused them to become ill so they will not get sick again; debt counseling teaches you how to manage your money so you will not fall into trouble with your finances again. It is very important that you understand the why before you can appreciate the solution. You are less likely to abuse your available credit if you understood how the bulk of smaller purchases compounded the large debt you accumulated.

Debt counseling also teaches you how to use your finances to increase your credit score and much more, such as:

- How to save for an emergency fund
- How to find the best interest rates
- How to make and stick to a monthly budget
- How to find the best health/ home/ auto insurance quotes

… and much more. Debt counseling is a priceless gift – make sure you value it as such.

The first thing you should do when you get two consecutive rejections is to check your credit score. If you find that your score has indeed plummeted, seek the best available credit debt solution.

How do you find the best possible solution? This part is easy – have a credit repair agency help you here. There is no one- size- fits- all solution for debt management. Each case is different and each case needs a personalized approach to get the financial matter resolved expeditiously. This is why most of the “template type” solutions do not work that well across the board; and why credit repair agencies are in such high demand.

The best credit debt solution for you needs to be worked out carefully so you can get out of debt as soon as possible. In the meantime, you also need to establish habits that exhibit financial responsibility to increase your credit score. Remember, financial devastation can happen overnight; credit repair cannot.

There are still plenty of people who make tons of money through credit repair fraud. Sad but true. These con men hope to find people who are upset and desperate about their income and debt positions. Many victims are acutely depressed and consider themselves’ complete failures, which is exasperated when they realize they have been duped. Conmen have a knack for identifying people with these vulnerabilities and targeting them.

Pay attention to these three very obvious scams and identify credit repair fraud before it traps you into doing something you will regret later. Here are 3 warning signs for you:

1. You are promised things that are “too good to be true” – This is a major warning sign. Do not believe that your credit score can change overnight.

2. You are asked to pay all fees upfront. Not only is requiring fees to be paid upfront illegal but it can also cause further financial hardship.

3. You are told you could use someone else’s Secret Security Number – This is obviously contrary to acceptable credit repair practices and can be punished severely by both federal and local authorities for credit repair fraud.

Perhaps you’re asking yourself, how would I even know if my credit report is accurate?

The answer is simple, you ask for a copy of your credit report. Legally, every consumer is entitled to one free credit report annually from each of the three credit bureaus and therefore, if you plan your requests accordingly, you can have one credit report every four months. Although the bureaus are different, they maintain more or less the same standards when calculating the credit score. That means you can keep a close eye on the things that creep in on your credit report, enabling you to appeal inaccuracies almost immediately.

It is very important to write to the credit bureau as soon as the discrepancy appears on your report. If you are not comfortable with writing credit dispute letters yourself, seek the assistance of a credit repair agency or counselor.

You will hear a lot about debt negotiation during the credit repair process. What is the role of this type of negotiation and why does it get so much importance? You will agree that every cent saved is a cent earned, right? Well, that is the answer.

When a credit counselor or agency negotiates your debts, they ensure that you are charged the minimum possible both in interest and in fines (and penalties for late payment). This means a drastic reduction in the size of your debt; which in turn means that it would be easier for you to repay the loan.

You can do debt negotiation on your own; but most people prefer professionals to do this job because it does require the special skill of effective confrontation and a talent for getting your opponent to agree to your proposition. The more money you are able to save the better it is for your financial outlook. So, can you see the importance of financial negotiations in the process of credit repair?

Credit repair is not always as easy as it seems. There are many complications that can exceed the capabilities of a regular agency, rendering their assistance ineffective at best to even more financially damaging at worst. It is at that time that the assistance of a credit repair attorney is highly recommended.

If you think that your financial matters need an attorney, ensure that you get a good one. Seek references from people whom you trust or request a free first consultation, which most attorneys are happy to provide. Go prepared to these meetings and ask all the questions that are pertinent to your case so you are able to decide whether this person can help you or not.

The advantage of having a credit repair attorney on your side is that you will have both credit repair and legal advice rolled into one. Remember credit repair agencies will only provide regular debt management advice. Have sufficient information to weigh your options and choose the financial advice that will benefit you most in the long wrong. Long term financial health can require a larger financial sacrifice in the present.

This is great news for you if you are about to file for bankruptcy because you are completely paralyzed by the bills that keep piling up; if your finances are touching the lowest rung and you have nowhere to go; if the only visible solution to you seems to be declaring bankruptcy.

So just what is Chapter 10 bankruptcy? This is a tiny clause in the Bankruptcy Act that can protect you from harassment and buy you time when you most need it. According to the US Bankruptcy Code, this chapter will permit a small company to avail of the court’s protection until they can work out a plan to extricate themselves from their financial impasse.

Chapter 10 bankruptcy is designed to aide small and micro entrepreneurs, who would otherwise lose their business to their creditors. Under this clause, the company will ask for a reasonable time during which they will draw up a realistic time and action plan to rebuild their financial base. If the Court find it acceptable, then the company will be offered protection under the Chapter 10 bankruptcy Act.

The main conditions imposed by Chapter 10 bankruptcy Act is that the company’s rejuvenating plans should not exceed three years or the total debt be more than US$2,500,000.00

Do they really help or are they only predators that feed on your helplessness and vulnerability?

They do help. In fact, it’s an excellent idea to file for bankruptcy through any one reputable such agency because;

1. They will advise you about the law of the land and how to get the best possible deal under the circumstances
2. They will protect you and your assets from any unwarranted harassment
3. They will leave scope for you to build a new future
4. They will teach you the best way to interact with the concerned officials – so you will be treated right
5. They will help you with counseling that will put you back on your feet in no time

From the above it looks like the bankruptcy firms deserve their money. Don’t you agree?

There is a lot spoken about credit repair scams. As a customer, you need to educate yourself about a few basic facts before you seek an ethical credit repair agency to help you out with your credit score. This is why the first thing you should do when you negotiate terms with a credit agency is to ask for a contract. This is your right. According to the Credit Repair Organizations Act, or CROA as it’s popularly known, the credit repair agencies are legally bound to:

* Give you correct advice about how to repair credit. They are forbidden to introduce you to illegal means to repair credit
* State correctly and clearly what are the services they will provide and charge you for
* Ask for payment only after the services promised have been delivered to your satisfaction; never pay upfront

Remember the Credit Repair Organizations Act gives you the right to sue any organization that violates the Act.

Many people complain about fraudulent credit repair companies without really understanding or know what the credit repair law state. If you pay attention to these pertenent laws, you will be able to smell out the scammers at the very first glance.

Fraudulent companies offer services that clash directly with the credit repair law of the country. However, without a knowledge of the laws, you are unable to recognize it and the result is often very tragic. The lesson here is that you need to know what services you can expect before you go searching for credit repair companies. Ensure that you research for information on how and what the law of the land permits you while attempting to repair your credit report.

You need not know the credit repair law in greatest details; aim for general awareness. This will ensure that you can identify and weed out false credit repair companies.

How responsible are you are when credit repair laws are broken by scammers? Most people would deny any responsibility, claiming that they were victimized by fraudulent credit repair companies.

Is this true? It depends. If you are looking for things that are outside the purview of the law, then you are, at least in principle, as culpable as the perpetrator himself.

The fraudulent credit repair companies exist because there is demand in the market for what they deliver. The demand comes from those who wish for – even demand – the impossible. “Fix my credit score now!”, “Remove my bankruptcy”, “Raise my score immediately” – these are some of the requests that encourage scam companies.

So why are people surprised when they are cheated? Consumers must realize that while credit repair companies perform a valuable service, they cannot perform miracles.

It’s imperative that one maintain realistic expectations in regard to improving their credit. The process takes time, and it’s just not realistic to expect overnight results.

As consumers, it would behoove us to avoid making unrealistic demands. It that were to happen, the scam artists and fraudulent companies would die a natural death!

The Fair Debt Collecting Practices Act is especially designed to protect you, the indebted, from being harassed by creditors and/or collection agencies. While it’s important that you pay money you have borrowed, in the event you are unable to pay, you will find protection against intimidating action of creditors and debt collectors under this Act.

Many creditors are tempted to harass you directly or through third party agents (collection agencies) in order to recover the money owed them. In such cases, you can file a suit against them under the Fair Debt Collecting Practices Act.

Keep in mind that no credit agency should:

call you at your work place unless you permit it

call you at odd hours – earlier than 9.00 AM or later than 10.30 PM

misrepresent themselves to obtain information from you, or anyone related to you

use abusive languages when asking you to repay the loans

threaten you verbally or physically
